A federal appeals court has rejected an effort to revive a lawsuit against Baytown Police Officer Juan Pedro Delacruz regarding the 2019 shooting death of Pamela Turner. The Fifth Circuit Court of Appeals upheld a Houston judge’s decision to dismiss the civil rights lawsuit, citing Delacruz’s qualified immunity.houstonchronicle.com

Turner, suffering from a mental health crisis, was shot by Delacruz after she grabbed his stun gun during a struggle. Although her family’s lawsuit accused Delacruz of using excessive force and being aware of her mental health issues, the judges ruled that he did not violate any clearly established law.people.com+3houstonchronicle.com+3time.com+3

The incident had received national attention and controversy over police violence. Delacruz was indicted for aggravated assault but later acquitted in a criminal trial. The Fifth Circuit’s decision may be appealed to the Supreme Court.houstonchronicle.com
