In 1991, Chief of Police Victor Jacalone transferred Captain William Failla to the night shift despite Failla’s known back injury. Failla alleged that this transfer aggravated his condition and filed a lawsuit under the New Jersey Law Against Discrimination. The jury found Jacalone liable for failing to accommodate Failla’s handicap, resulting in compensatory damages awarded to Failla.
