On February 2, 2020, Officer Lower approached Tamara Hires in a bank parking lot without observing any criminal activity and arrested her without legal justification. Hires alleged that excessive force was used during the arrest, resulting in injuries. She was detained until the next day, at which point the prosecutor declined to pursue any charges. Hires filed a lawsuit against Officer Lower and others, alleging false arrest, excessive force, and malicious prosecution. The court allowed the false arrest claim to proceed but dismissed the excessive force and malicious prosecution claims due to insufficient factual details.
