In August 2022, Lt. Bergeson confronted a First Amendment activist filming police vehicles and personnel. He was later suspended for eight days for ‘use of force’ after bumping and blocking the path of the individual. Bergeson filed a complaint against the chief and captain, alleging retaliation and inconsistent application of use-of-force policies. In January 2025, he filed a federal lawsuit claiming that department and city leaders retaliated against him for his union activities and warnings about inadequate staffing during the 2022 Sailfest.
