Sgt. Matthew Higley – Utah County Sheriff’s Office

On February 21, 2010, Sgt. Matthew Higley and another officer entered the apartment of Plaintiff Schultz without a warrant, after Schultz refused to allow them entry to check on his wife. The officers physically restrained Schultz and forced him to sit in a chair inside his apartment. This led to a lawsuit alleging violation of constitutional rights. The court found that the officers’ actions raised questions about the legality of the warrantless entry and use of force, allowing the case to proceed to trial.
