Fountain Police Officer Marcus Howard is being sued in federal court over an October 2022 incident in which he and another officer forcefully removed a man, Kyle Fisher, from Fisher’s home without a warrant. Howard responded to a 911 call about a child welfare check at Fisher’s residence and, after Fisher refused entry, Howard entered the house, grabbed Fisher, dragged him outside, and arrested him despite having no probable cause. The arrest was later deemed improper – the charges against Fisher were dropped within days and the police chief apologized – and Fisher’s lawsuit alleges Howard violated his Fourth Amendment rights; an internal investigation was completed but Howard remains on the force as of the lawsuit’s filing.
