    Major Kelley was found liable in a 2003 case for the unconstitutional detention of a pretrial detainee, Mr. Hayes, who was held for 38 days without being taken before a court. The court determined that Kelley exhibited deliberate indifference to Hayes’ rights by failing to investigate grievances and ensure a prompt court appearance. Kelley was held liable in his individual capacity, and Faulkner County was held liable for the unconstitutional policies and customs adopted by Kelley and Sheriff Montgomery.
