Sheriff Montgomery was held liable in a 2003 case for adopting unconstitutional policies that led to the prolonged detention of a pretrial detainee, Mr. Hayes, who was held for 38 days without a court appearance. The court found that Montgomery, as an official policymaker, was responsible for the policies that violated Hayes’ constitutional rights.
