    Sheriff Montgomery was held liable in a 2003 case for adopting unconstitutional policies that led to the prolonged detention of a pretrial detainee, Mr. Hayes, who was held for 38 days without a court appearance. The court found that Montgomery, as an official policymaker, was responsible for the policies that violated Hayes’ constitutional rights. Both Montgomery and Major Kelley were held liable in their official capacities, and Faulkner County was held liable for the unconstitutional policies and customs they adopted.
