    In 2018, Sheriff Ana Franklin was sued by former employee Mr. Sherman, who alleged that she retaliated against him for perceived speech by giving him an ultimatum: resign or lose funding for his defense and indemnity in a pending § 1983 action. Faced with this choice, Mr. Sherman resigned, claiming constructive discharge. The court found that Mr. Sherman adequately alleged a constructive discharge, as Sheriff Franklin’s actions were intended to make his working conditions intolerable, forcing his resignation.
