In 2019, Deputy Sheriff Cunningham was implicated in a lawsuit alleging failure to provide adequate medical care to inmate Haile Neil, who was known to be suicidal. Despite observing Neil’s unusual behavior, including withdrawal and refusal to eat, Cunningham allegedly did not take reasonable measures to abate the risk, leading to Neil’s death. The lawsuit claimed violations of the Fourteenth Amendment and negligence under California law. The court denied the motion to dismiss these claims, allowing the case to proceed.
