Deputy Wesley Smith – Mariposa County Sheriff’s Department

Deputy Wesley Smith was involved in the 2015 arrest and prosecution of Jerry Cox, who faced multiple felony charges including sexual assault. The charges were dismissed in 2017 when evidence showed the allegations were false. Cox subsequently filed a federal lawsuit alleging that Smith and other deputies disregarded exculpatory evidence and conspired to suppress it, resulting in his wrongful arrest and prosecution. The lawsuit also accuses Smith of fabricating evidence and participating in retaliatory code enforcement actions against Cox’s property. The case is ongoing as of 2021.
