In March 2011, Corporal Ronald Whitman instructed civilians Norma and Jim Gund to respond to a neighbor’s 911 call, failing to disclose critical information about the call’s urgency. The Gunds were subsequently attacked, resulting in severe injuries. The Gunds filed a lawsuit against the County, alleging negligence. The court dismissed the case, ruling that the Gunds were acting as de facto employees and were thus limited to workers’ compensation claims. Whitman faced no disciplinary action for his role in the incident.
