In May 2021, Undersheriff Ferguson, along with Deputy Sheriff Brian Angiano, was involved in the forceful drawing of blood from Bryce Rosemore following a traffic stop. Rosemore alleged that the officers obtained a search warrant without probable cause and that the blood draw was conducted forcibly. The case was dismissed in August 2021, and Rosemore filed a lawsuit seeking damages of $400,000. The court recommended dismissal of the Fourth Amendment claim against Ferguson, with leave to amend, due to insufficient facts to determine the validity of the search warrant and the officers’ qualified immunity.
