In 2016, Sheriff Ernie Kelty and Deputy Sheriff Matt Swabey were involved in a lawsuit filed by David Murphy, alleging unlawful entry and seizure of property without a warrant. The complaint detailed that Kelty and Swabey climbed over a fence to seize a trailer and forcibly entered Murphy’s shop, causing property damage. The lawsuit included claims of malicious prosecution, abuse of process, and unlawful search and seizure. The court dismissed the claims against Kelty and Swabey in their official capacities, but the case highlighted concerns about their conduct during the incident.
