In 2018, Correctional Officer Bailee Cheever engaged in a sexual relationship with inmate Cole Noeldner. The relationship included sexual intercourse in the jail’s medication room. Cheever was aware that her conduct was prohibited by jail policies and illegal under state law. After the relationship was discovered, Cheever’s employment was terminated, and she pleaded no contest to third-degree sexual assault of Noeldner. Noeldner filed a lawsuit against Cheever and other jail officials, alleging violations of his constitutional rights. The court denied Cheever’s motion for summary judgment, allowing the case to proceed.
