On October 22, 2018, an unknown U.S. Marshal allegedly witnessed the physical and sexual assault of prisoner Scott Lewis Hashemian by another marshal but failed to intervene or stop the assault. Hashemian claimed that this marshal watched the incident and did not respond to his yells for help. He filed a lawsuit alleging violation of his Fourth Amendment rights. The case was dismissed without prejudice for failure to state a claim on which relief may be granted. [Source: Hashemian v. U.S. Marshals, Case No. 3:18-cv-00286-TMB, Dec 11, 2019]
