Chief McManus defends SAPD’s handling of sex-on-duty allegations against officers

Incident: In 2022, Officer Jonathan Reyes, a decorated 12-year SAPD SWAT officer, was accused of engaging in a sexual affair while on duty. An internal complaint and subsequent investigation found that on August 24, 2022, Reyes left his assigned post in the middle of a shift, drove to a hotel (an Embassy Suites across town), and spent nearly three hours there, allegedly to meet with Officer Tammy Ayala (SAPD’s physical fitness coordinator)​

. Forensic analysis of Reyes’ phone and hotel records confirmed multiple on-duty hotel rendezvous and an affair, which raised concerns of sexual misconduct on duty​

. Such behavior violates SAPD’s policy prohibiting sex while on duty, especially if it involves anyone the officer has a mentorship or supervisory relationship with (Ayala oversaw some of Reyes’ training)​

Outcome: Reyes was not fired; instead, in the fall of 2023 he received a brief suspension. He served a 5-day suspension in late September 2023 for neglect of duty related to leaving his post, a significantly lighter punishment than the original allegations of on-duty sexual misconduct suggested​

. SAPD officials declined to discipline Officer Ayala, the fitness trainer involved, and Chief McManus stated that because she wasn’t officially under investigation (and state law limited disclosure), her name was not released​

. The reduction of the allegations and minimal penalty for Reyes drew criticism and questions about favoritism. Nonetheless, after the 5-day unpaid leave, Reyes returned to duty. The incident became public during his divorce proceedings, but internally the case was effectively closed with that minor disciplinary action​

. (No lawsuits or criminal charges arose from this incident; it was handled administratively.)
