In 2017, Deputy Hersberger was involved in an incident where he took an elderly woman to the ground and arrested her at a Western Colorado University football game. The woman filed a federal civil rights lawsuit alleging excessive force and unlawful arrest. In 2021, the case was settled, with the county’s insurance paying $250,000 to the plaintiff.
