Deputy James Atnip – Marshall County Sheriff’s Office

On March 24, 2011, Deputy Atnip was involved in an incident at the Marshall County Medical Center where he, along with other officers, attempted to restrain Johnny Manuel Leija, a patient exhibiting aggressive behavior. During the confrontation, Leija was tasered and physically subdued, leading to his death. A lawsuit alleged that the officers used excessive force and violated Leija’s constitutional rights. The case, Aldaba v. The Board of Marshall County Commissioners, was reviewed by the 10th Circuit Court in 2015, which discussed the officers’ actions and the applicability of qualified immunity.
