In 2012, a lawsuit was filed against Deputy Atnip and others in the Eastern District of Oklahoma, alleging that their actions during the March 24, 2011 incident at the Marshall County Medical Center resulted in the death of Johnny Manuel Leija. The lawsuit claimed that the officers used excessive force and violated Leija’s constitutional rights.
