In April 2009, Deputy Maston, along with Trooper Shaun Curran, arrested Mr. Wagner without a clear reason, leading to allegations of excessive force and violation of constitutional rights. The charges against Mr. Wagner were dismissed in September 2010. A civil suit was filed in March 2011, alleging assault, battery, and intentional infliction of emotional distress. The court denied summary judgment for the defendants, indicating genuine issues of material fact regarding the officers’ conduct.
