In April 1998, Detective Cary Milligan sought an arrest warrant for Ricky Beauchamp based on allegations of rape by a woman named Klingerman. Milligan testified that Klingerman identified Beauchamp as her attacker and that a polygraph indicated she was truthful about the attack. However, at the time of seeking the warrant, Milligan lacked a signed statement from Klingerman and a medical examiner’s report. Beauchamp was arrested and his home searched. The charges were later dismissed, and Beauchamp filed a lawsuit alleging false arrest and defamation. The court granted summary judgment in favor of Milligan, citing qualified immunity.
