In 2018, Officer Aaron Pew was involved in the arrest of Cole Spencer, during which Pew kneeled on Spencer’s back and head while he was handcuffed and lying face down. Spencer complained multiple times that he could not breathe. The 9th Circuit Court of Appeals ruled that Pew is not entitled to qualified immunity, allowing Spencer’s excessive force lawsuit to proceed to trial.
