In April 2006, Officer Benjamin Harvey arrested Maria Rosenfeld for interfering with a peace officer after she failed to comply with his orders during an incident involving her daughter. Rosenfeld filed a lawsuit alleging violations of her First and Fourth Amendment rights, claiming the arrest was retaliatory and lacked probable cause. The court granted summary judgment in favor of the defendants, concluding that Officer Harvey had probable cause for the arrest and that there was no evidence of retaliatory motive.
