On April 29, 2013, during a vehicle stop for a turn signal violation, Officer Bryan Bourbeau struck passenger Strain in the right temple with a nightstick or flashlight after Strain objected to a search conducted by Officer Mark Minnick. The blow caused Strain to bleed from his right ear and resulted in injuries including broken vertebrae. Strain was charged with resisting law enforcement, but the charge was later dropped. Strain filed a lawsuit alleging excessive force and other claims against Bourbeau and Minnick.
