In 2019, Capt. Penny Phelps was recorded instructing a subordinate to act aggressively so that a Black suspect would perceive the deputy as a ‘white supremacist’ or ‘neo-Nazi.’ This directive was related to the ‘Tree House murder’ case. Phelps was terminated in December 2019 following the public release of the recording. She subsequently filed a lawsuit alleging wrongful termination based on her sexual orientation, but the case was dismissed in March 2023.
