In March 2016, Officer Boigenzahn sexually assaulted inmate Rachel Slabey by touching her genital area under her clothing while she was in her bunk. Prior to this incident, in August 2015, he was suspended for three days without pay for violating the jail’s fraternization policy by passing notes between inmates and engaging in non-sexual physical contact with an inmate. Despite these violations, he was reinstated without additional supervision. In May 2016, after further inappropriate conduct, including receiving a romantic note from an inmate, he was terminated. Inmate Slabey filed a lawsuit against Dunn County, alleging that the Sheriff’s Office was deliberately indifferent to the risk posed by Boigenzahn, leading to her assault.
