In January 2014, Sgt. Smith was involved in an incident where an entire three-ounce can of pepper spray was discharged into the cell of inmate Wellington M. Waggener, who had mental health issues and was being held in the medical observation area. Waggener was left without decontamination or relief for over five hours. Then-Sheriff Steve Mansfield described the incident as ‘disgusting and embarrassing’ and subsequently fired Sgt. Smith for his role in the mistreatment. In June 2015, Lewis County paid Waggener $300,000 to settle potential claims related to the incident.
