Deputy Boigenzahn engaged in inappropriate behavior with female inmates, including passing notes and making physical contact. Despite initial denials, he admitted to these actions when faced with termination for dishonesty. He was suspended for three days but later reinstated to his normal duties without additional supervision. A jury found that his actions created a known or obvious risk of sexual assault, and that the Sheriff’s decision to reinstate him reflected deliberate indifference to that risk.
