In 1991, Deputy Fisher participated in the arrest of Evelyn Shoop at a polling place. Fisher received orders to remove Shoop based on an oral directive. He and another deputy spoke to limited witnesses before attempting to arrest Shoop, resulting in a scuffle. A lawsuit followed, alleging constitutional violations due to arrest without probable cause and use of unnecessary force. The court found that the deputies, including Fisher, did not have probable cause or reasonable belief in probable cause for the arrest.
