    In June 2022, Deputy G. Messer was named as a defendant in a civil rights lawsuit filed by the family of Robert Lee Daniels Jr. The lawsuit alleged that Messer, along with other officers, was involved in the events leading to the wrongful arrest and charging of Robert and Michelle Daniels as accessories after the fact. The charges were ultimately dropped because West Virginia Code § 61-11-6 specifically excludes parents from the class of persons capable of being accessories after the fact. The lawsuit alleged violations of the Daniels’ constitutional rights, including wrongful arrest and excessive force.
