In August 2011, Deputy Gardner arrested Mr. Mglej without probable cause, charging him with failing to identify himself and obstructing justice. The charges were eventually dropped. During the arrest, Deputy Gardner applied handcuffs too tightly, causing Mr. Mglej prolonged pain and long-term nerve damage. The Tenth Circuit Court of Appeals denied Deputy Gardner qualified immunity on claims of false arrest, excessive force, and malicious prosecution.
