In January 2016, Deputy Gary Habinyak was implicated in an incident where inmate Jeffrey Scott Miller was brutally assaulted by his cellmate, James Howard Dively, at the Bedford County Correctional Facility. Despite Miller’s and other inmates’ cries for help, guards allegedly ignored the situation. Habinyak discovered Miller in a pool of blood during a routine check, after the assault had occurred. Miller filed a lawsuit alleging negligence and failure to protect, resulting in a $60,000 settlement paid by Bedford County in July 2022. The lawsuit highlighted the guards’ deliberate indifference to Miller’s safety and well-being.
