In June 2022, Deputy J.D. Tincher was involved in the arrest and charging of Robert and Michelle Daniels as accessories after the fact. The criminal complaint listed Tincher, along with Deputy Sipple and Defendant McCown, as complainants. However, Sipple was the only officer to prepare, sign, and submit the criminal complaint. The charges were ultimately dropped because West Virginia Code § 61-11-6 specifically excludes parents from the class of persons capable of being accessories after the fact. This led to a civil rights lawsuit filed by the Daniels against Tincher and other officers, alleging wrongful arrest and other violations.
