In the same August 11, 2000 incident, Deputy Benrud confronted inmate Douglas Richer about a rule violation. The situation escalated, and Benrud struck Richer in the right eye with his elbow during the altercation. Richer filed a lawsuit alleging excessive force. The court denied summary judgment for Benrud, allowing the excessive force claim to proceed.
