On March 4, 2018, Deputy Jimmy Ward was involved in a police pursuit that ended with the shooting of Ricky Duncan. Duncan alleged that upon exiting his vehicle with his hands up and a gun in the air, Deputy Ward, without giving any verbal commands or warnings, began shooting, striking Duncan multiple times. Duncan filed a lawsuit claiming excessive use of force in violation of his Fourth Amendment rights. The court denied Deputy Ward’s motion to dismiss, rejecting his qualified immunity defense at the motion to dismiss stage.
