Deputy Kolkemo was involved in an incident where he struck inmate John Lee Malaer in the face during intake at the Jackson County Jail. Kolkemo described the action as a ‘diversionary strike.’ Malaer was also placed naked in a cell and shackled to a floor grate. Kolkemo received a one-day suspension without pay. A federal magistrate ruled that a jury could find the use of force excessive and part of an informal custom within the jail.
