Deputy Witten was involved in drafting and executing a search warrant in 2015 based on Sheriff Kirk’s claim of smelling marijuana from 150 feet away. The search led to the discovery of 147 marijuana plants, but the charges were dismissed after it was argued that the search was based on false information. A lawsuit was filed against Deputy Witten and others for alleged constitutional violations and other claims.

In 2016, Deputy Witten arrested Joe and Linda Evans after a search of their pawn shop led to the discovery of controlled substances and a stolen firearm. The charges against Joe Evans were later dismissed, and Linda Evans’ charges resulted in a ‘no true bill’ from the grand jury. The Evanses filed a lawsuit against Deputy Witten and others, alleging violations of their constitutional rights.
