In October 1991, Sergeant Don Lawyer arrested protester Habiger for disorderly conduct during a demonstration near a clinic. Habiger alleged that Lawyer violated his First and Fourth Amendment rights by arresting him without probable cause and using excessive force. The case, Habiger v.
