In October 1991, Sergeant Don Lawyer arrested protester Habiger for disorderly conduct during a demonstration near a clinic. Habiger alleged that Lawyer violated his First and Fourth Amendment rights by arresting him without probable cause and using excessive force. The case, Habiger v. City of Fargo, was litigated, and the court ultimately found that the officers were protected by qualified immunity on the probable cause and First Amendment issues.
