In January 2021, Officer Fernandez-Rosa was accused of inappropriately touching a female inmate. Following an internal investigation, he was arrested on January 29, 2021, and suspended from duty. He resigned approximately one week later. In February 2021, a criminal complaint charged him with sexual assault based on his conduct towards the inmate and a fellow corrections officer. He pleaded guilty to third- and fourth-degree sexual assault and was sentenced to three years in state prison and three years of extended supervision.
