In April 2021, while serving as a deputy jailer, Evans assaulted inmate Elton Bailey by placing him in a chokehold and repeatedly punching him without legal justification. This excessive use of force led to Evans being fired from the detention center. He was later federally indicted and pleaded guilty to one count of deprivation of rights under color of law. In August 2022, Evans was sentenced to two years in prison, followed by three years of supervised release, and was ordered to pay $100 in court costs. Additionally, Bailey filed a lawsuit against Evans, the jail, Jailer Steve Tussey, and the Madison County Fiscal Court, alleging excessive force and seeking damages for physical and emotional pain, medical expenses, and other costs.
