    James, an officer with the Pinal County Sheriff’s Office, was terminated for failing to perform required maintenance on the Intoxilyzer 8000 breath alcohol testing device, leading to the dismissal of several DUI cases due to lack of evidence. He admitted to not performing some of the required maintenance but claimed he was unaware of his assigned responsibilities. The Pinal County Employee Merit Commission found that the Sheriff’s Office had not proven, by a preponderance of the evidence, that James had failed to complete his assigned duties, leading to legal proceedings regarding his termination.
