In 2020, Deputy John Christianson arrested Tony Berger on charges including strangulation and suffocation, disorderly conduct, and intoxicated use of a firearm. Berger alleged that Christianson violated his Fourth Amendment rights by unlawfully detaining and arresting him, searching his home, and seizing his firearm. The district court dismissed Berger’s claims, concluding that Christianson had probable cause for the arrest and that the search and seizure were valid due to consent.
