On September 28, 2009, Officer John Mueller responded to a complaint from Tamela Montgomery regarding violations of a protective order by her ex-boyfriend, Bailey. Mueller interviewed both parties but did not arrest Bailey. Later that evening, Bailey broke into Montgomery’s home and shot her. Montgomery filed a lawsuit alleging that Mueller’s inaction contributed to the attack. The court granted summary judgment in favor of Mueller, concluding that his actions did not violate Montgomery’s constitutional rights.
