Sergeant Marc Nelson was involved in an incident during a protest in Perry Square in May 2020, where he was caught on video kicking a seated protester, Hannah Silbaugh, in the shoulder. The city initially suspended Nelson for three days without pay; however, the Erie Fraternal Order of Police union grieved the suspension, and a mediator set it aside in November 2020 before Nelson had served any of the suspension. The city settled Silbaugh’s federal lawsuit for $45,000 in 2022.
