Lieutenant Byrd filed a federal lawsuit on January 21, 2014, alleging retaliation and discrimination by the Asheville Police Department. The suit claimed that after his wife filed a sexual harassment lawsuit against the department in 2010, Byrd faced adverse actions, including excessive assignments, exclusion from meetings, and hindrance in taking approved family leave. The lawsuit sought damages and the removal of negative material from his personnel file.
