On April 29, 2013, Officer Mark Minnick conducted a vehicle stop between 2:30 a.m. and 3:30 a.m. for a turn signal violation. During the stop, Minnick began searching the vehicle without the driver’s permission. When passenger Strain objected to the search, Minnick removed him from the vehicle. Another officer, Bryan Bourbeau, then struck Strain in the right temple with a nightstick or flashlight, causing injuries including broken vertebrae. Strain was charged with resisting law enforcement, but the charge was later dropped. Strain filed a lawsuit alleging excessive force and other claims against Minnick and Bourbeau.
