In 2016, Investigator Smirnoff pursued a suspect on a four-wheeler. After the suspect surrendered and was handcuffed, Smirnoff lifted him into the air and slammed him to the ground multiple times. He also slammed the suspect’s head into the side of a patrol car. The suspect was compliant and did not pose a threat. Smirnoff pleaded guilty to federal excessive force charges in April 2019 and was sentenced to 22 months in prison in July 2019.
