    In 1977, Deputy Michael Kendrick was dismissed for using offensive language towards ambulance service members, threatening criminal penalties without justification, and likely employing excessive force during an arrest. The Nicholas County Deputy Sheriff’s Civil Service Commission upheld his dismissal, finding ‘just cause’ for termination. The Circuit Court of Nicholas County initially reversed this decision, but the Supreme Court of Appeals of West Virginia reinstated the dismissal in 1981.
