In August 2023, Luna County filed a lawsuit against Sheriff Mike Eby, accusing him of multiple violations, including illegally demoting and reassigning deputies without cause, overspending the department’s budget by 33% in six months, and violating procurement codes. The county also alleged that Eby issued a deputy commission to a non-deputy employee, granting her unrestricted access to sensitive areas, and interfered with an investigation into a fatal crash involving a deputy. The lawsuit sought to compel Eby to comply with state laws, county ordinances, and the collective bargaining agreement with deputies.
